US H-1B Visa News: Most Indians working in America work in the tech sector. H-1B visa is required for tech sector jobs. For H-1B visa, the company/employer has to fill the I-129 form and submit it to the ‘United States Citizenship and Immigration Services’ (USCIS). Through this, the company requests that the foreign worker be allowed to enter the country. For H-1B visa, companies have to fill the I-129 form on behalf of their employee.
At the same time, an important information has been given by USCIS regarding the I-129 form. USCIS has updated the I-129 form for H-1B and H-2 visas. This new form will be issued from January 17, 2025 next year. Applications made through the old form will be canceled. USCIS said that companies have to apply under the new form from now on. The US government has said that the purpose of this change is to make the application process easier and better, so that transparency can be brought.
What is the important information regarding the form?
According to USCIS, the new form will be released on January 17, 2025 and will replace the form of January 4, 2024. No grace period i.e. extra time has been given for this. If someone has applied with the form of January 4, 2024 before January 17, 2025, then his application will be accepted. If someone applies with the old form after January 17, then that application will be rejected. After January 17, only applications with the new form will be accepted.
What is the filing process for H-1B visa?
For H-1B visa, American companies have to fill the I-129 form on behalf of their employee and submit it to USCIS. For this, many types of documents are required, such as employee’s qualification, job offer letter, work experience letter from the previous company, information about projects and salary rules documents. Along with all these documents, the company has to fill a new I-129 form and then send it to USCIS along with the fee.
The company can apply online or send it to the USCIS center through post. It is very important to ensure that the correct form is used. USCIS will check the application and may ask for additional information if needed.
