Senior advocate Sanjay of Dhanbad Court has given a legal answer to this question.

Definition of adult and their rights

According to Indian law, a person is considered an adult after completing 18 years of age. This age is 18 years for girls and 21 years for boys. An adult person has the right to roam, live, or stay in a hotel anywhere. This is their constitutional right and under no circumstances can the police arrest them only on the basis that they are an unmarried couple.

Possible situation during police raid

If the police raid a hotel and catch adult couples, there is no legal basis to arrest them, unless any criminal activity is taking place. According to advocate Sanjay:

If the girl and the boy support each other:

In such cases, the police cannot arrest them. Adult couples have the legal right to stay in a hotel.

Importance of the girl’s statement:

If the girl makes any serious allegation against the boy or changes her statement, then the boy’s arrest is possible. The case is heard in the court, and if found guilty, the boy can be sentenced to 1 to 1.5 years.

If no complaint is filed:

  • In such cases, the police have no basis to arrest the couple.
  • Entry of unmarried couples banned in hotels like OYO

However, in many cities of India, entry of unmarried couples has been banned in OYO and other hotels. This ban is due to the policies of the hotel management and local social pressure. But this is not a legal rule. Adult couples have the legal right to stay in a hotel.

Legal protection and advice

According to advocate Sanjay, adult couples should be aware of their legal rights. If the police intervenes in case of a dispute, they should stay calm and seek legal help.

Cooperate with the police and show proof of your adulthood. If the police exerts pressure in an unfair manner, contact your lawyer immediately. Make sure that the identity cards of both of you are deposited with the hotel management while staying in the hotel.

Need for social awareness

Conservative thinking about unmarried couples is still prevalent in Indian society. But the law protects their freedom and rights. Society should change this thinking and respect the private life of legally adult persons.
