Perhaps you too must have seen this scene or it may be that in real life also you must have seen the traffic police taking out the keys from the vehicles. Is there any such law to remove the key from the car? Can a traffic policeman do anything he wants? If not, how to take action against such people? Today we are going to answer all these questions of yours in this article. Let us tell you today what are your rights as a driver.

Who can deduct the challan?

According to the Indian Motor Vehicles Act 1932, only a traffic police personnel above the rank of an assistant sub-inspector can impose fines for violating traffic rules. Only ASI, Sub-Inspector and Inspector are allowed to impose fine on the spot. Traffic constable or home guard etc. are there only to help them. However, they also have no right to remove the keys from your vehicle, nor can the traffic policeman remove the air from the tires of your vehicles.

If caught by the traffic police, keep these things in mind:

The traffic policeman can impose fine on you only if he has a challan book or e-challan machine. Without any of these things, he cannot fine you. The traffic police should be wearing a uniform bearing their name badge. If the traffic police is in civil dress then you can also ask them to show their ID card. The thing to keep in mind is that the head constable of the traffic police can impose a fine of just Rs 100 on anyone. Only an ASI or SI rank policeman can impose a fine of more than Rs.100.

Cannot remove the key No

Traffic policeman has the right to remove the key from your vehicle. If a traffic policeman does this, then you can record this incident. By recording, you can complain about this to the senior officer in the nearest police station. Keep in mind that you must have your driving license and pollution control certificate while driving. Apart from this, you should also have a copy of your car’s registration and insurance papers. You can also use the digital format of these papers.

Fine can be paid later

If your challan is deducted, and you do not have the money to pay the fine on the spot, then you can pay the fine later. If a police personnel misbehaves with you during checking, you can complain to a senior officer.
