US District Judge Tanya Chutkan rejected Save Jobs USA’s petition, saying that the spouse of an H-1B visa holder is also allowed to work in the US. Save Jobs USA’s petition was opposed by tech companies like Amazon, Apple, Google and Microsoft. This decision of the court will benefit one lakh H-1B visa holders. A large number of Indians are included in these.
Court Rejects Save Jobs’ Appeal
Save Jobs USA argued that Congress has not given the Department of Homeland Security authority to allow spouses of foreign nationals, such as H-4 visa holders, to work in the US. The Court rejected this argument, saying that Congress had intentionally given the US government the right to authorize employment as a condition of the spouse’s stay in the US.
According to a media report , lawyer Ajay Bhutoria, who provides legal aid to immigrants, hailed the court’s decision saying that the H1B visa program has been extended to allow skilled workers from other countries to come to the US and work in companies here. was applied for.
