H-1B Visa: There have been some major changes in the US H-1B visa program, which have been in the headlines for the last few days. These changes have come into effect from today, Friday, January 17.
The new rules have provided relief for students studying in the US on F-1 visa. While the H-1B visa application will be under review, their F-1 visa will be automatically extended till April 1, so there will be no disruption in their legal status and employment rights.
The US administration says the changes to the H-1B visa program are aimed at ensuring fairness, transparency and efficiency in recruiting foreign talent to the US. Indians account for the largest number of such visa holders. Of the 3,86,000 H-1B visas issued in 2023, 72.3% were given to Indians. Experts say Indian tech professionals are likely to benefit the most from these changes.

qualifications to be temporarily employed. According to the US Citizenship and Immigration Services (USCIS), these reforms are intended to simplify the visa approval process and increase the flexibility of the program, so that employers can retain their talented team. The US Department of Homeland Security (DHS) has stated two objectives for modernizing the H-1B visa program – first, to clarify the requirements of the H-1B program and increase its efficiency. Second, to provide greater benefits and flexibility to petitioners and beneficiaries.

The US Department of Homeland Security has defined the requirement to maintain a “direct relationship to the degree” as a “logical connection.” This means that there must be a logical connection between the degree and the job responsibilities.
