Washington: The annual limit of all available US immigrant visas under the employment-based fourth preference (EB-4) category for the fiscal year 2025 has been exhausted. Business Today has given this information in its report citing the official announcement of the US government. According to the report, this development will affect Indian applicants among other applicants. The completion of the annual limit means that no EB-4 green cards will be issued until the new fiscal year begins on October 1, 2025.

The EB-4 visa category is primarily reserved for religious workers, certain special immigrants, and international broadcasters. The US Immigration and Nationality Act (INA) limits the number of employment-based green cards issued each year, with 7.1 percent of the total employment-based quota allocated for EB-4 visas.

What does this mean for Indian applicants?

No EB-4 visas until FY 2026: Indians seeking EB-4 green cards will have to wait until October 1, 2025, when the new annual limits will come into effect again.

Embassies and Consulates Cannot Issue EB-4 Visas: U.S. embassies and consulates have been instructed not to process EB-4 applications for the remainder of FY 2025.

Options for Indian applicants

The annual limit of EB-4 visas being reached could lead to an increase in backlogs and delays, which will impact Indian applicants already in the queue. With the annual limit of EB-4 visas being reached, applicants may consider alternative US visa routes such as EB-1, EB-2 or EB-3 visas, H-1B visas and family-sponsored green cards.

When will EB-4 visas resume?

The EB-4 visa process will resume on October 1, 2025, at the beginning of fiscal year 2026. Eligible applicants can expect the consular process to resume at that time.
