It will not be easy to get a passport for a minor without the permission of both parents. If a single parent applies for a passport, he will have to provide more information and supporting documents than before. He will also have to explain the reason for not getting consent from the other parent.
The Ministry of External Affairs has recently made changes in the Annexure ‘C’ (declaration from parents) attached with the application of a minor. Passport application will not be considered if correct information is not given in Annexure ‘C’. If consent of both the parents is given with the application for passport of a minor, then Annexure ‘D’ has to be filled and if consent is given by only one parent, then Annexure ‘C’ has to be filled. In this, correct information was often not given by the applicants. Many such cases have come to light in which complete information was not given due to dispute between the parents.
The reason given for not getting consent from the other parent was that the parent is staying abroad. Earlier, it was not mandatory to provide proof of staying abroad in such cases.
At the same time, when a divorce case is going on in the court, it was not mandatory for a single parent to provide information whether the court has given him the custody of the child or not. While making a passport, it was also not mandatory to submit such documents which show that the court has not imposed any condition or restriction on issuing the passport. After such cases came to light, the Ministry of External Affairs has now made these changes in the rules for applying for a passport for a minor by a single parent.
In these cases, documents will have to be given along with the information
● If one of the parents is living abroad and is unable to give permission, then a copy of their passport and visa must also be submitted.
● If one of the parents is travelling abroad, a copy of the passport, visa along with ticket or boarding pass will have to be submitted.
● In case of divorce, the single parent will have to submit a document regarding the right to custody and care of the child to the court along with the application.
● In case of divorce or pending case, if the court has not imposed any injunction regarding passport, then a copy of the divorce petition will have to be given.
● In case of divorce or if the court has imposed an injunction regarding the passport while the case is pending, then consent of both the parents or permission of the court will be required.
