Traffic Rules: When the traffic police issues you a challan, you can ask the challaning policeman these questions. Know what you can do in such a situation and what are your rights.
In India, under the Motor Vehicles Act, certain rules have been made for vehicles to ply on the roads. All drivers have to follow them. If the rules are violated, a challan is issued by the traffic police.
And not just the traffic police, but the cameras installed on the traffic lights can also issue you a challan. If you are breaking any traffic rule like jumping a red light or over speeding, then in such a situation also the traffic camera can issue you a challan.
Most of the challans are issued by the traffic police. When the traffic police issues you a challan, they can issue it to you too. For example, you can ask the traffic police the reason for issuing the challan. You can ask for which traffic rule you are being challaned.
Apart from this, you can also ask under which law and which rule your challan is being issued. The police officer present on the spot will have to inform you about which rule you have violated and under which rules your challan is being issued.
If you do not want to pay the challan immediately and want to pay it online, you can ask the police officer present there how the e-challan system will be for paying the challan online. Or you can ask whether the challan will be given in cash or online.
If you want, you can also ask the police officer for his identity card while issuing a traffic challan. You should pay the amount only if your challan is issued from a challan book or e-challan machine, otherwise not.
After the challan is issued, you must obtain a challan receipt from the concerned police officer present on the spot. Even if you have violated the traffic rules, the police cannot misbehave with you. If any officer does this, note down the name of that officer and complain against him at the nearest police station. Or you can also complain online.
