Family Pension Rule: Centre issues guidelines on distribution of family pensions in case of two wives of govt servant

Pension is considered an important part for any employed person. Everyone is worried about their future that how will their family run after the job. In view of this, arrangements for family pension are made.

But do you know that if a government employee with two wives dies, then who will get the pension? Will the second wife get pension or not?

The Pension Department of the Government of India has announced amendment in the Central Civil Services (Pension) Rules 2021 and Rule 50 of the Central Civil Services (Pension) Rules 2021. This rule is related to the family pension of any employee.

What is the rule of family pension?

If any government employee is a Hindu and he marries for the second time while his first wife is alive, then it is a violation of the provisions of the Hindu Marriage Act 1955. It is also contradictory to the provisions of CCS (Pension) Rules 2021.

According to the circular issued by the Pension Department on October 10, 2024, “These cases have been examined and it has been decided that such cases need to be resolved as per the provisions of CCS (Pension) Rules 2021 and the issue of second wife or second wife.

Each case will be examined separately to determine whether the second marriage is legally valid or not. The Department of Legal Affairs will examine the validity of the second marriage before taking any decision regarding eligibility for family pension.”

In fact, Rule 50(6)(1) of the CCS (Pension) Rules, 2021 refers to “widow” and “widower” as the spouse who was lawfully married to the deceased Government servant or pensioner.

How to divide pension between two wives?

If a government employee or pensioner dies and he has one or more widows, then the pension will be paid equally to both. And in case of death or disqualification of the widow, her share of the family pension will be given to her child.
