That is why most passengers prefer to travel by train. But it has been seen many times that many accidents have occurred while traveling by railway.
In which passengers have suffered a lot. Many times passengers’ luggage has also been stolen in the train. Recently a person’s bag was stolen in the train. For which the National Consumer Dispute Redressal Commission has ordered the railways to pay Rs 4.7 lakh to that passenger. Let us tell you when and how compensation is given in case of luggage theft in railways.
Railways will give compensation of Rs 4.7 lakh to passengers in case of stolen luggage
The National Consumer Disputes Redressal Commission has held the railways responsible for the theft of a passenger’s luggage and has asked it to pay him a compensation of Rs 4.7 lakh. Actually, the case dates back to 2007 when Dilip Kumar Chaturvedi, a resident of Durg, was travelling in the sleeper coach of a train from Katni railway station to Durg railway station. During this time, some cash and luggage worth Rs 9.3 lakh was stolen at around 2:30 am.
After this, he complained about this in Durg District Consumer Commission, after which South East Central Railway asked to give him compensation but Durg and Bilaspur GRP station in-charge challenged the decision of South East Central Railway in the State Commission. After this, Dilip Chaturvedi filed a review petition in NCDRC i.e. National Consumer Disputes Redressal Commission.
In which he told that due to the negligence of the TTE, unauthorized people entered the coach and committed the theft. The luggage was made of chain and full preparations were made for its security. But due to the negligence of the TTE, the luggage was stolen and due to this reason Section 100 of the Railway Act does not apply in this case.
When do we get compensation?
Indian Railways has made some rules for giving compensation for stolen luggage. Under Section 100 of the Railway Act, Indian Railways will not be responsible for any luggage unless the railway employee has booked the luggage and has not given the receipt to the passenger. Or according to the rules, if the passenger is carrying luggage with him. Then the railway will not be responsible for it unless it is proved that the luggage has been stolen or lost or damaged in any way due to the mistake or negligence of the railway employees.
Follow this process
When a passenger’s luggage gets lost in the train, in such a situation the passenger first has to contact the train conductor, coach attendant, guard or GRP escort. After this, the passenger is given a complaint form. After filling it, it is sent to the GRP police station. If you do not get the luggage after 6 months, you can go to the consumer form and complain. After this, the amount of your luggage is worth, you are given compensation of that amount by the railways.
